Stupid Nanny State Continues

The new cellphone ban law will prohibit the use of the cellphone as a navigation device even if mounted on the dash of your car in acradle.

This sort of namby-pamby bullshit was supposed to end with the change of government but it just rolls on as officials just don’t seem to get it.

Just to clarify, it is alright to have a mapbook open on your lap but not ok to use the GPS navigation function on your smart phone with audible directions.

This is stupid law that is unworkable. Why not ban the eating of hot meat pies, the smoking of cigarettes and the drinking of coffee while we are at it as they have caused far more accidents than the use of cellphones?

    I agrre. There are only two principled options:

    1. The status quo where the police can charge a person for any act that the officer believes is objectively careless (cellphone, eating, reading etc….); or

    2. Make it an offence to be holding any other object while driving (cellphone, eating, reading, makeup, smoking etc).

    The problem with the first option is that it requires police to prove objective carelessness as an element of the offence, whereas the second option assumes that any other act done while driving is careless and saves police having to prove anything other than the act of doing or holding something else while driving. I prefer the second option as several years ago a truck driver drove his scania into the back of my wife's car while lighting his cigarette, sending glass all over my baby daughter in her carseat..
