Another Judge just doesn't get it

It seems that the judiciary is filled with panty-waists hell bent on ignoring society and their wishes.

Psychological stress made a prominent Northland civil servant commit four fraud offences.

But naming him would cause suffering that far outweighed the offending, a judge has ruled.

The man appeared for sentencing in Kaikohe District Court yesterday. He had previously pleaded guilty to four charges of using a document for pecuniary advantage – a form of fraud that carries a maximum term of up to seven years’ jail.

The offences were committed between July and October last year. On four occasions, the man took a price sticker from a cheap bunch of flowers at a supermarket and put it on a more expensive bunch before going through an automatic checkout.

The total amount defrauded was less than $100.

Whether it is a $100 or $1 or a million dollars it is still fraud. The offender plead guilty and the Judge discharged him with no conviction fully suppressing all of his details, she also used the Capill Precedent. Of course by now the whole of the far north will know who the person is so a few quick questions to some mates will soon enlighten me.

The Judge has it so wrong it actually isn’t funny. Instead of one line in the local rag noting xys was convicted of fraud today in the Kaikohe District Court, it has now turned into a rather large article about why the Judge suppressed the name and now has made publicity of the rather pathetic crime into something the whole nation wants to know because he made something small a secret. The judge is an idiot. She needs to Google Streisand Effect.

The person who did this is just having excuses made for his crime. He is a thief, plain and simple.

    I agree wholeheartedly in principle with your closing comment. We should brook no panty-waisted no-dickery from those who depart from the norms of civilised society. "Psychological" problems shouldn't be accepted as an excuse for those who steal. Or those who can't be arsed working for a living.

      "Our" feelings? Have I stumbled upon the official hang-out of the work-shy community? But seriously, it would appear that some people round these parts aren't as accepting of the leisure-time/poverty relationship as you are.

        A very good point Homas and well made indeed.

        I think those who chose not to work need to take a reality check or at least learn to manage finances if they think the money the hardworking taxpayer gives them each week forces them into 'poverty'. Would love to see them tell hard working people living in shanty towns overseas who earn 10cents an hour in a factory how hard done by they are.

    The only supermarket up here that has auto tills is the New World in Kerikeri opposite the police station.
    A senior civil servant can only be a somebody senior in the council or a cop. A thief is a thief is a thief. This is a disgrace, the guilty person was not stealing food. Unless they eat bouquets of flowers that is.

    Does`nt anybody get it? The judiciary exist only for the protection of the rights of criminals, you and I have no rights until we commit a crime and then they will fall over themselves to ensure our rights are not infringed(unless of course you challenge the judges rulings).
    If you or I are the victims of a crime,well just tough shit,harden up the judge does`nt give a fuck.

    Read the courts section in the local newspaper. There are countless nobodies commiting similar fraud and thievery who get named. This is just bullshit. You cannot blame stress on comitting crimes and harming others. This person needs to be named to the community and take responsibility for their actions. Apart from the shopkeeper, there are no other victims here. Besides, if they are elected, people have a right to know this.

    Someone needs to investigate Judge Babara Morris. Probably brakes down in tears during some court hearings!

    If it was the unemployed , 18 year old brown brother, there would have been a photograph in the paper as well. Just to ridicule him some more because it was such a shitty theft.

    If this was a first offence why wasn't the police diversion scheme used.??????????????????????????

    If it wasn't used in this case I would suggest that this guy has been convicted of something previously. I know for a fact 98% of first offenders get the diversion scheme, even though it was initially set up for minor offences, not Crimes Act matters like this.

    If that is the case this is an absolute travesty not just a travesty. But it wouldn't be a cop because the media would be all over him even if he was an ex-cop and served 37.8 years ago

    The "psychological stress" referred to with be the stress of having finally been caught.

    This will not be isolated offending, he will have been committing similar frauds.

    Same as that retired Judge in the North Shore facing $4000 charges for a keying a car parked hear his driveway. He'd been doing it to countless cars but finally got caught too.
