The Dirty Downloader Case

The case of the Dirty Downloader in Palmerston North has had an interesting turn of events, events that make the decision of Judge Grant Fraser simply apalling. Keeping Stocks explains why:

We have been made aware of the identity of the Prominent Palmerstonian- from several independant andunrelated sources. We were also made aware of something yesterday which, working in the ECE sector, we found rather chilling. After much internal debate between me, myself and I, we decided that this needed to be put in the public domain, but in a manner which would not breach the Court-ordered suppression.

So we ask this question; did Judge Grant Fraser know that the Prominent Palmerstonian’s business premises share the same street address as a pre-school? We believe that this is a very important question in the context of Judge Fraser’s decision to allow name suppression. This is indeed a case of public interest.

Ponder this; do the parents who send their children to the pre-school involved have a right to know that its neighbour had an unhealthy interest in children? For us, that’s a no-brainer; we can’t think of a clearer case where publication of the defendant’s name IS in the public interest.

There are many other questions and allegations about the relationship between the Judge and the defendant swirling around, questions that need to be answered, in the meantime with the information that Keep Stock has posted I think the Crown prosecutor should be in court immediately seeking an urgent appeal to the sentence and suppression in this case.

Bear in mind that the Dirty Downloader came to the attention of the FBI. His activities are not nothing, theya ren’t something to be swept under the carpet.

    The judges comment below basically means that if you continue to offend and download overseas child porn, then you will get name suppression… Hmm… this is great news for defence lawyers!!!

      Quite so Rav – it's a cop-out on the part of the sentencing judge. The problem for Judge Fraser though is that this case has outraged so many people that his suppression order is going to be rendered completely and utterly ineffective.

      2.It is required to flush out accomplices’ other prominent people from other professions probably. Every prominent person probably knows every other prominent person.
      3.When they are unable to travel to destinations where this sort of thing is a big problem they will indeed turn their attention to home.

    It worries me that a ‘learned’ judge deems that downloading approximately 300 000 photos of abuse does not merit harsher punishment and identification purely because they are photos of overseas children. Perhaps the judge needs to contact the FBI to find out why they were concerned if he cant figure it out for himself. Take the suppression decision making away from the judges as they are proving to show extremely poor judgement. Makes you wonder about the rest of their performance too.

    Does anyone know the facts of this case? I have heard and read conflicting reports.

    I heard some guy ring Leighton who said he specialised in computer forensics. He was saying all the reports he heard was that the photos were of girls in sexual poses. What does that mean naked girls? Does it mean girls masturbating? I then heard on TV3 that some of the photos included children having sex.

    I do not condone any of these photos. However we are criticising a judge. I think the criticism is justified but we should not embellish the case. I also heard the man hating lawyer who thought Father’s Day should be a day of shame comparing the name suppression of the man with a mechanic in Whangarei. This guy got 2y 2m jail and no name suppression. She compared the charges and the number of photos but neglected to say he have a previous conviction for having sex with a boy under 12 – hardly a fair comparison.

    I reiterate I would not condone the viewing of nude photos of underage girls. This can be a serious matter depending on how they were obtained. I heard of computer repairmen lifting photos on computers they repair. It is one thing for a family to have and show nude pictures of 3 or 4 year olds and another thing for them to be on the internet for the titillation of some pervert.

    It would be nice to get some facts about the case such as this and also any relationship the judge had with the pervert and if there was a relationship should the judge have declared it and stood down from the case. I think the public have a right to know.

    Key needs to intervene on this and the judge needs to justify why some high flying private school arsehole with 300,000 (!) sick images including child porn is getting name suppression. Like Mr Money before him, soon NZ will know this guy's name and so they should. He deserves everything that is coming his way. I feel bad for his kids but it is in the public interest to know who to keep their kids well clear of.

    The judge has concluded that there is not likely to be any future offending either.

    The public are not thought to be under risk from this solitary, sick and sad offending.

    The extended offender's family, particularly if the offender has a distinctive surname should not be punished for the offender's sins by publishing the man's name.

    Punishment and treatment are called for for the offender, but I feel for his family.

    Steven Price (Vic Uni Law school – media)suggests on his blog that media and the likes have missed the story and Boo hoo to them. perhaps what should happen now and people should band together and be at the Court ona turn by turn basis and publish names of this people the minute they attend court. They should blog the name even before the Judge finishes his summary on the day and grants name suppression. I mean, lets face it… if someone is being brought to court for keeping child porn, they have been brought there after police investigation re they would have checked the time that person was on the net, had images etc etc…

    I think doctors have been a '' very, very protected species '' in this country for far too long……there is some other case going on in CHCh involving a doctor..don't get the press so can't tell you the details. My friend and I , more so her, were sexually assaulted by a foreign doctor who picked us up hitchhiking..he was a busy guy ..got picked up soon after , had been doing similiar things to much younger girls at the hospital he was working at in the Central Nth Island. He was jailed and deported.
    Quite a few years later, I was sexually well invaded by an old geezer at Hutt hospital who was supposed to be checking my heart.. I was alone in a large room with him and he started asking me about orgasms..I'll spare you some of the other details.
    Really , truly how much of this stuff goes on? and how much of it is covered up?
    I think doctors should be treated exactly the same way as any other person committing the same crime.

    I happen to be a paedophile and I have an addiction to child porn. I don't abuse children and I don't look at hardcore CP (child porn). If you people had ANY IDEA how many padeophiles are out there, you'd be absolutely beside yourselves with fear. How many tears has he shed in self hatred? How many long nights of complete darkness has he spent, trying to understand why he thinks the things he does? Give him a break, let him get on with his life after serving his term and maybe getting some psychiatric help or something.       Drug addicts have to stop taking drugs and the same goes for all addictions. If it means that you have to throw away your computer then do it. You admit you have a problem so the next step is to do something about it. If you are caught then the next step is for the public to know who you are. You say you can't do it by yourself, well the public knowing will be the best help and support you could ask for as they will ensure that you are kept away from the internet and from children. At the moment WO has been told by the doctor to stop drinking coke as he has a heart problem caused ( I think ) by the medication he has been put on but worsened by his addiction to drinking coke.     What madness to let the offender back in the place where the crime was committed.
    Being a professional hasn't made him exempt from committing the crime so why the slap on the hand with a wet bus ticket.
    It's like telling a drunk driver, go hide down at the pub for 4 months till everyone forgets about this and then drive home.
    In four months this guy will be allowed to walk amongst us again.
    Two years of downloading such material is an addiction. We hear nothing of help or rehabilitation.

    I disagree. Maybe the pictures came from overseas websites or sharing and possibly distributed overseas but that does not indicate that the victims were solely from overseas.
    What on earth am I on about (getting myself lost here) It shouldn't matter where the victims came from. Forget their address and remind yourself they are children. What do people overseas see. We can let our professionals download pictures of their abused victims and almost get away with it?
    Who's to say the pictures weren't of Kiwi kids, obtained by overseas persons to sell / trade / distribute on their overseas websites?

    And the judge sees publicity would not flush out offenders
    (well this publicity could assist Internal Affairs to trace Mr Paedophiles IP address)
    and enable the public to keep themselves safe from you.

    Well that says it all. He sees no reason why the public cant take action to keep themselves safe from him. I wouldn't want to hurt him but if my kids needed medical attention I could have an informed choice as to who I took them to. If anything our kids are our responsibility to protect from danger.
    So whats dangerous about images on the computer screen?
    The danger is how you perceive children and the transformation becoming more and more blurred between reality and the images on screen. Maybe it doesn't happen to everyone in D's situation but I wouldn't want to take the chance. With someone in such a position and the ability for opportunity to occur more often than Joe Blogs the danger in my opinion is tenfold to any regular paedophile (hard for me to get a scale on this sort of thing) and should be recognized.

    This is not an animal welfare site, rather run by professional psychologists with an amazing success rate. The course is a year long intensive therapy but rather costly although that can be altered depending on income or circumstances. (the least of your problems)
    Your problem isn’t genetic, more likely caused by situation and in many cases drug / alcohol altered.
    It’s like you have tunnel vision and are not letting yourself be aware of the damage those pictures are doing. Ask yourself “Would your wife / girlfriend let you take pictures of them naked and post them on the net”? Of course not. But coerce a child who doesn’t have the understanding of the consequences and the after effects are life long psychological damage which lead to disrupted relationships through to suicide.

    One picture leads to more demand, fueling the addiction and hurting more children.
    How dare the sentencing judge say “No children in NZ were affected” He would not have access to the addresses of the large portion of 300,000 victims. Percentage wise there is every likelihood that one or more children in NZ were the victims of his crime. There is no proof (yet) that DrD’s offending has / could have lead to hands on offending with patients. It’s very likely as the demand for more grows. Or it could be that behind a computer screen you don’t see the images as children but objects for your titillation.

    Warning!!! Maximum sentence for possession of objectionable material (Child Porn) is 5 years. For distributing the same material, 10 years.

    I would just like to add
    Joe Blogs from Hauraki area, 56000 images, after intense investigation found no evidence of distributing any images, the presiding judge wanted to set a precedent and gave him 3 years imprisonment with one year off for early guilty plea. No name suppression even though the prosecution verbally stated to the judge he was of good character, came from a highly respected professional family, actively involved in community organizations “The community needs to know who this offender is amongst them and as part of your sentence be aware of the shame you have caused your family” (judges sentencing notes) and (as I know him) a very like-able guy although I never thought he would be into such depravity.

    My conclusion: There is no equality or fairness in the NZ Justice system.

    What if one of those 300 000 images downloaded was that of Madeleine McCann? How would the judge justify his sentencing / name suppression then? Not that any one of those poor children should have to be high profile in order for a judge to care. Taking a photo of a child being posed or abused, let alone distributing that photo, is abuse. There is no consent. There is no excuse. The judge should have asked himself what if one of those pictures was that of his daughter or grand daughter and viewed by some mild mannered person not likely to offend against a child in his community in another country? Would he have been as lenient?
    Anyone with paedophilia tendencies who consider viewing photos is not as bad as touching a child are just kidding themselves and havent yet made that move. That child did not consent. There is no excuse.
    If correspondents in this blog who identify themselves as moral paedophiles were genuinely moral, they would have sought psychiatric help long before blogging. Perhaps they should spend more time online seeking help rather than seeking those nasty sites.

    of all the crimes in the world – your crime is by far the worst, the most devastating & the one that shatters my heart into a thousand irretrievable pieces every time I hear of it.

    I was not abused as a child & to my knowledge neither were any of my three sisters, but I went to school with kids who were & sadly so were some of my closest friends. One of my most disturbing memories & a day that I will never forget is when, in the middle of a math lesson, my extremely agitated male class mate stood from his seat tears streaming down his face & announced through a torrent of sobs to the entire class the ongoing abuse that he simply could not hold in anymore. For years he had been abused by a well-known & convicted paedophile, who unfortunately for this young man lived only four doors down. Now that his seven year old brother had fallen victim to sodomy he felt compelled to tell. I will never forget that poor boy, so ashamed – so hurt & so afraid. I watched him enter into adolescence & his life spiral out of control. At 13 he was heavily into solvent abuse & I can only imagine where he is now….
    As a mother of two sons, there is one thing that I know for sure. If anyone ever laid a hand on either of my boys I would hunt them down & I would not stop until they had died an horrid, horrid death. I do not condone violence nor am I a violent person but I would take the greatest joy in concocting some hideous & torturous end to the life of this person(s).
    I too think your so-called addiction is a mythical device you use to make yourself feel better, and sadly I think castration is the only option. Quite simply, YOU do not deserve to inhale the air that our sweet sweet children do nor does your footfall now, or ever will, have a place on this earth.

In my opinion your only half a step away from offending – and ‘kidding’ yourself if you think you wont – at the young age of 22 you may or may not have offended but you will! & in the course of your lifetime it won’t be one or two it will be many, probably family members of children of friends….. you might even go on to have children yourselves…. you sick, sick fucks!     I believe that being sexually attracted to children is something that you cannot control the same as people who are gay cannot control that. I have never thought of it from your point of view before. I was sexually abused by a relative when I was very young and as a result have been very protective of my children and thankfully they have never been harmed. I am 39 and still remember in detail what he did to me and will always be distrustful of men because of it. I was very surprised that I felt empathy (not sympathy) for you, it is because you have not harmed anyone and do not want to. I sincerely believe you cannot control the fact you have such thoughts, and I want to applaud you for speaking out about it, that was very brave just to write the words I imagine! I agree that there needs to be a support system for the males AND females to help them come to terms with their situation and give them knowledge of how to control it so as to not harm children and themselves. I have been abused, and lost a baby born with a heart defect but I would truly never want to be in your position so please remember that some people do not hate that which they do not know and cannot understand. I hope you can find the needed support system that you deserve. Ignore the haters and ignorant, they do not know any better.

I’m speechless over the amount of uneducated people writing into this forum. There is no such thing as a degree of life from the university of Telly.
    The law is still the law and this guy ought to get a stronger sentence, however, its not for you to decide his fate. Let face it, his life as he knew it is over. His career is over, His wife and kids will leave him. He’ll have to leave the country etc. He’s buggered already (pun intended) but have u walked in this man shoes for 2 minutes let alone his lifetime? Research proves that most rapists and paedophiles were once victims of abuse themselves. Hurt people hurt people. and thats the kicker. You wanna change it? You say you want understanding but we cannot give it to you! You need serious counselling if at 22 you are attracted to children still. Do yourself a favour and seek professional help!!! PLEASE!
