What is this crap?

A judge has granted permanent name suppression to a prominent Manawatu man who downloaded more than 300,000 pornographic images, many of children.

The man, who was charged with 25 counts of possessing objectionable material and one count of distributing pornographic images on the internet after an FBI investigation led to his arrest last year, was sentenced to four months’ home detention when he appeared for sentencing in Palmerston North District Court yesterday.

So you like watching kiddie porn but the judge suppresses permanently your name because you are prominent? WTF are the judges on.

Many of the images had young naked girls posing in sexualised positions.

Judge Grant Fraser said he granted permanent name suppression to protect the man’s family, his mental state, his wife’s job and his ability to rehabilitate.

“I’ve also accepted without hesitation the public interest and the public being aware of the character of you, and I’ve also taken into account the seriousness of your offending,” Judge Fraser said.

“In this case there is no offending against any individuals within the New Zealand community.

Excellent the Judge has decide that 300,000 images of kiddy porn isn’t serious offending, why? Is it because he has a million pictures himself? He is suppressing his name so that his family won’t have to experience shame, well shame on you Judge Grant Fraser, shame on you.

He has suppressed the name because of his public standing. What public standing? He is a kiddy-porn addict, scum, exploiter of children, that is his public standing, that is what the public is entitled to know. If I knew his name I would out him. I think it is high time we started shaming Judges.

    He had 300,000 pornographic images
    Potentially 25 or fewer were objectionable
    As few as 2 were kiddie porn

    Yet the screaming headline on this piece says 300,000 kiddie porn images were found, the known facts don't support that.

      So two images are ok? Two is less criminal than 20? Afraid not. This person has been dealt with very leniently. There is no witch hunt, and I assume he plead guilty to shut the case up. People in his "occupation" do not go down without fighting if they are innocent.

    300,000 images at perhaps 1 minute each to select, download, and file/save amounts to 5,000 hours. Non-stop daily sessions of 8 hours each would amount to 625 days, or 1 year plus the next through to October 1

    Dave, I get what you're saying and agree with you. I think this guy sounds like he got off way too lightly… but the point is we dont know the facts. We are just assuming based on tidbits of information taken out of context, we might be right that the guys evil as hell.. but he also might just be an ordinary guy with a porn addiction, doesnt make him a kiddy fiddler. He's obviously guilty, but sentencing takes into account the facts of the case, not simply on the charge.

    Also the name suppression wasnt granted to protect him, it was granted to protect his innocent family. Whether thats appropriate or not should be the point of the discussion.

      WO has to got to court to defend putting up some images that some people may or may not have been able to interpret into a name that was not even the legal name of a person with name supression…… YET they were freely discussing the ACTUAL name over on Trademe yet they decide to charge WO.
      They should go back to Trademe where they can safely and blantantly break supression orders. Over here they are not safe as the powers at b have decided to make an example of this particular blogger.

    Judge Grant Fraser also prohibited publication of the student's name when he appeared before him in Palmerston North District Court on Friday……
    He added that publication of the defendant's name would hamper his ability to "move forward" and would impact on his rehabilitation..

    300,00 images total – no indication of the number of illegal images, could be as few as 2 now couldn't it?
    From a tech PoV, the chances of each image being d/led individually, mmm, nil – so more likely that they were Zip/Rar etc, archives. So, potentially the convicted wouldn't even know that he was getting kiddie pr0n.

    However, as the guy was convicted I assume that he would have opened the files and looked at the contents, still possible that he was unaware that there were any illegal images there. This is where the law gets a bit sticky, as it's an offence to possess such images, even if you don't know that you have them

    That being said, the name suppresion after conviction is a disgrace.

    Again, no mention of them being under the age of consent – I'd describe a 16yo as young myself, but then I'm an old git.

    In addition if you, say, torrented a file, you'd in effect be distributing it before you received (and opened) the file, and it's quite possible that you'd still be distributing it after you'd fully received it and still not even looked at it.

    Name suppression is given out far too freely nowadays unlike when I was growing up and being named was part of the consequence you paid for breaking the law. It served as a great deterrent to young people as well, because we all had a healthy fear of trouble with the law affecting our future prospects in terms of travel and employment.

    Nowadays we bend over backwards to shield offenders from bearing the full weight of consequences for their actions. As for the judge's excuse about rehabilitation that's bollocks. Genuine rehabiliation is all about accepting responsibility for what you've done and earning people's trust back. When people don't know what you've done you don't feel the same need to prove yourself to the community again, so in actual fact name suppression is hindering true rehabilitation.

    I don't agree with the name suppression and I don't support being an accessory to child abuse. But to me it seems very likely that this guy downloaded so much porn that the sheer volume guaranteed he might have grabbed the odd illegal photo. It may even have been possible that he downloaded it, looked at the 25 images, went *ugh* and deleted them immediately. That still counts as possession under the law and is still an offence. So frankly, I am going to trust the judge on this one, since we don't know all the facts. Though yes, we should have the right to know the man's name.
