No Bail for Turangi attacker

The Police must have very good evidence as the arrested 16 year old in the Turangi attack case has not sought bail and is currently in custody where he will remian at least until January 12.

Usually the Judges get all soft and crim hugging over Christmas/New Year and let scum walk the streets, not so in this case:

The 16-year-old charged with a sexually charged attack on a 5-year-old at a Turangi campground on December 21 has not sought bail.

He appeared briefly in Taupo Youth Court today, watched on by a gallery filled with family members and media.

He is next due to appear on January 12.

Earlier, the detective heading the investigation into the attack said New Zealand society needed to take a good look at itself.

Detective Inspector Mark Loper spoke at a press conference this afternoon before the 16-year-old appeared in court.

He said it was concerning that a 16-year-old could commit such a serious offence.

        Maybe people wouldn’t be so quick to to be anti-name suppression if one day they were charged with something you didn’t do and public knowledge of it would ruin your career prospects and make people mistrust you basically forever.

        bobbyk2k, I’m not against name suppression in all circumstances. I am against its almost automatic usage by judges for no other good reason than e.g. “the [alleged] offender wants extra time to tell his grandmother” or “he’s a prominent sportsperson” or “he makes people laugh”. Name suppression was never originally meant to be used the way the judiciary are increasingly applying it in NZ. For better or for worse, shame is a strong anti-crime motivator.

      I think this detective was not making reference to any puppies, his point was far more desecrate. He as a police officer is not able to comment directly about one particular section of NZ society but his words echo the underlying sentiment in this country and the shocking underclass amongst us. I will point no fingers but the fullness of time will reveal the underclass I believe he was referring to……

        It’s a pretty unfortunate reaction, the (liberal/media) rush to blame some wider community for the actions of a subgroup of bad apples. One incident earlier this year absolutely defined the phenomenon for me. Nearly twenty ‘men’ and ‘boys’ gangraped an 11 year old girl in Cleveland, Texas. After they were arrested, a number of media organizations interviewed a number of their relatives, who said some pretty despicable things about the victim. From there on, it turned into a confusing national media frenzy, where not only was everyone in Cleveland a rape apologist (rather than just some people quite similar to the perps), but the initial reporting on the case was equally nasty for reporting the views of two or three scumbags, and it apparently should have followed every apologetic for underclass perversion with a “Rape is bad, mmmkay.” Absurd.

        The last thing I would like be accused of is racism Mike, hence my post above. Nobody in this country has the right to accuse a particular race of any collective wrong doing BUT it has to be said there are problems within some ethnic groups and in particular Maori with violence and serious crime. The above said, at this point there is no indication about the ethnicity of the attacker but I fear in the fullness of time my suspicions will be confirmed to my great embarrassment as a New Zealander.

    Negotiate?!!! What negotiation is there to have?

    The no bail application will more than likely be that there was no High Court Judge available for a bail hearing due to the “hols”.  The charges are rightly serious and a Youth Court and District Court Judge can’t bail on the ones that have been laid.

    He gets automatic name suppression because he is appearing in the Youth Court.  Nobody can do anything about that

      just because this [alleged] offender is 17, he immediately gets “Youth court” and immediately gets name suppression and immediately gets in line for a wet bus ticket.

      I would argue the following

      1) The law mandating under 18 = youth = suppression is an ass and it neds to be changed.

      2) Certain crimes (rape, murder, kiddie fiddling) should supersede the “youth” ruling for court trials all over a “certain” age [I’m not a psychologist or psychiatrist but I would suggest based on developmental dynamics, international precedent and NZ’s own, internal precedent (Kuariki) that this “certain” age = 12.    

      3) Certain crimes (rape, murder, kiddie fiddling), as above should have automatic name disclosure unless this compromises a victim

      4) Certain crimes (rape, murder, kiddie fiddling) should have extended penatlies in NZ law, or even be considered capital crimes.

    OK, can one of our lawyers please tell us where to from here. He’s 16 and due to appear in the Youth Court. Presumably at some stage the legal system has to start treating this scum as an adult given the serious nature of the crime. Exactly what is the process?

      Agree. One thing that worries me…it is just not natural
      for a man( and 16 is a man) to sexually attack a little child. Everything a
      normal adult feels is the need to protect children and to look at a young
      girl-child as a sexual object is just not normal. This young man is sick and
      needs to be assessed and locked up for a very, very long time. My hubby and I
      both assumed it was some kind of paedophile as we could not comprehend a normal
      person doing that to a small child. In fact I feel bloody sick when I think
      about it. Hubby was particularly horrified as we have a daughter whom we love
      and protect as best we can. He hates the way society portray men as potential wife
      beaters and child predators.(thanks in part to media hype). I am obviously
      blessed.

        I completely agree. I was expecting this to be the crime of a grown man and if he were ten or fifteen years older there would be an almighty uproar but from what i can tell he gets the pity vote because he is 16. It’s his upbringing (which I would imagine is true)… 
        Perhaps the deal was that the family get protection for turning him in?
        But let’s be clear. What he did is abhorrent.He waited until the parents were out. He locked the door. He raped her then bashed her to a pulp. He stole and then ran away. He knew what he was doing.She is 5 years old. Her childhood has been stolen from her. She may not consciously remember the attack but something will always be there, there will be triggers. He doesn’t deserve protection, pity or compassion.

        I agree with the sentiment of being locked up for a long time, but unless he is locked up for actual life (which we know doesn’t happen here) or given the death penalty, he needs real rehabilitation so when he is eventually released, he is a stable safe member of our community.

      And restorative justice, without rehabilitation and treatment programs only perpetuates the myth that violence and power brings results.

    1) He’s been arrested & remanded….not tried & convicted.  Put the nooses back in the drawer.

    2) It is only a sub group of Maori who commit crime.  There’s a shitload of good Maori who like good Pakeha don’t need to take a good look at themselves. We don’t need a guilt trip.

        I get where you are coming from, as I think do most posters.  But I think there are a bunch of people here (me included) that have little to zero faith left in the NZ courts, its “judges” or ‘justice system’. 

        The community seems to favor harsher penalties, while the bench seems to favor lesser smacks on the wrist with wet bus tickets (not to put too fine of a point on it).

        I sincerely hope you have never been a victim or violent crime, but suspect that if you had you’d be bitter and disillusioned too due to the offenders “rights” and the current obsession of the NZ courts with oppressing victims.

    What I can’t understand is our laws obvious inconsistencies. They deem a 16 year old as an acceptable consentual age for sex yet when a dropkick scumbag like this (regardless of race) robs a little girl of her childhood through sexual violation and he is 16, he is tried in a youth court. Please tell me where the hell the sense is in that?  Our system obviously thinks that a 16 year old is adult enough to handle a physical relationship so why can’t they be deemed old enough to accept consequences for offending? You can’t have it both ways.

    Why isn’t the justice system user pays like everything else? Is part of the reason that we don’t make criminals do longer sentences because of the cost? The crim should run up a bill, that is either paid for in part by the family or himself. Perhaps, if the crim is truly rehabilitated, truly turns over a new leaf, the “loan” could be wiped. Prison doesn’t seem to be enough of a consequence. Perhaps if the family were in some way punished they would do more to keep each other on the straight and narrow? Perhaps if you knew that you would pay for a crime for the rest of your life, you wouldn’t commit it?

    While channel surfing tonight there was a documentary on E channel (yes I know, E of all channels) about kids who kill. Interestingly enough, in America, life imprisonment means life. Parole usually doesn’t come up for another 30 or so years. We need tougher sentences – where appropriate.

    I’ve got to say that I don’t think the issue here is race, moref the little girl whose life has been shattered and her faith in the human race left in tatters. Something is seriously wrong with this degenerate and all the namby pamby bullshit isn’t going to help. Our criminal behaviour in this country just seems to be getting worse in relation to the sorts of crimes that were commited 30 years ago in comparison to now. So I think the punishments of today should reflect that. There is so much PC bollocks and softly softly and it’s made things worse. You have crims reoffending to go back inside, why would you want to leave when everything is on the hardworking tax payers dollar? and you get a couple of hundred for the “steps to freedom” when you get out, when they reoffend we should demand that money back!     Everytime something horrific like this happens, I cringe – hoping it’s NOT going to be a Maori. The nation flares up to a multi-level dialogue of things much deeper than the crime itself. Redneck whites voice up and so do opportunist Maori. White people get the opportunity to say Maori are ‘bad’ and Maori get the chance to say the challenging statistics are due to white man’s historical crimes. Neither attitude is productive. We need to unite as ‘Kiwis’ for Pete’s sake. The fact is, that some Maori do have their hand out all the time. But guess what? The reason why some European Kiwis are getting pissed is because it’s not going into THEIR hands. We’re all greedy. But, I think we can all safely say that throwing money at inequalities is not the only way to face a challenge, that is not maori or ‘pakeha’ issue.. But a ‘Kiwi’ challenge. Before we can make positive progress, we need to unite.
    I’m optimistic that if we take united ownership as Kiwis for some of the deeper issues here, with honest and pragmatic dialogue, objectivism in the forefront of our minds and a lot of sensitivity. Then, we will make progress for all New Zealanders.

      I agree – we don’t know the girl or her family, haven’t had to see pictures or take statements. We don’t have to protect the offender while at the same time wanting to rip his balls off. I cannot begin to imagine how hard this investigation has been for the police involved. At least they caught the bastard.

    That 16 year old is sick. He is unlikely to ever be rehabilitated. Tthis ‘individual’ (I don’t quite know how to refer to him) probably comes from a bad back ground. But you know what? A bad back ground doesn’t make you someone who sexually attacks a 5 year old girl – do what ever you like with ‘him’ but he is evil. And he will always be evil. Evil can’t be fixed – it can sometimes be controlled, but it will never go away completely. I know it sounds really judgemental and usually I am all for rehabilitation but acts like that at that age speak to a level of sickness and evil that you and I just can’t comprehend.

    crime but I am genuinely surprised that a 16 year old would attack a child like
    this – there has to be more to it – I want facts – how did he know the child,
    he had only a few minutes of opportunity to get into the caravan, was he
    stalking the family?  Did he live in the
    camp, had the parents seen him before? – how did the police find him? By locking
    the caravan door he will be crucified and if he is found guilty of sexually
    abusing this little girl he needs to be locked away for a very long time and
    treated as a common paedophile.  But let’s
    have the facts first.

    Nobody comes from being an honourable citizen to causing such a horrific attack. There has to be a pattern or similar developing past behaviour and it should be included in this court case as relevant information. He has to be already known by agencies involved in health and justice. And upon seeing any progression from ‘petty’ crime / nasty behaviour to such an awful and serious crime, I would ask, who was responsible for him as a youth? What measures were taken to stop any pattern developing? And how was this managed and by whom? And what role does their negligence / poor performance play in the allowing vile behaviour to develop. We can all name half a dozen agencies that would have been involved in this youth’s life prior to December 2011.
    However, he is obviously old enough and capable enough to take responsibility for his actions. The legal system will take care of that. The unfortunate thing is that the legal system does not necessarily reflect any justice.Name suppression and no bail are probably for his safety. Thank goodness the public couldnt 
    identify his ethnicity when the media has noted that his family/whanau were present at court. I would suspect any ethnic group that does not have ‘whanau’ in its primary language is not identified as such.Where to from here? The legal process will probably make us feel impotent if justice is not served. So perhaps we work to change the law to favour the victim and not the perpetrator. If that doesnt work, let us hold our children close and love them dearly.

    ….I’m totally appalled at this crime, but why are so many people forgetful of the whole “innocent until proven guilty” policy we live by?  As mentioned above, how would you feel if you were incorrectly accused and charged of a crime you didn’t commit?  

    If he’s found guilty, by all means name and shame him.

    I’m loving all this common sense regarding punishing the little shit for life etc but would have been great if you all could have turned your ‘sensible sentencing’ opinions into a vote for ACT, at least then we may have been able to get a ball rolling in Parliament. Perfect they ain’t but if it means holding National’s feet to the fire over issues like this It would have been great to have to them in government with more force. Just sayin…..

    If we assume that this is indeed the perpetrator then we can be sure that when he is released from whatever detention he serves he will be a blessed asset to the community having given up his predeliction for sex with children and have assumed the mantle of  benefactor to us all – I’m confident that will happen but if I could be wrong and my grand daughters form part of his next sexual gratification/social statement I am confident that any action I take would ensure the safety of vulnerable children for evermore from this sad, sick individual. If this has any elements of social protest claimed for it then the sheer cowardice of the act confirms that as a lie. His values have been learnt at the knee of whoever raised him and a glance into the attitudes and activities of those around him will be likely to suggest a wider degree of culpability.

    thank goodnes for the whip around to financially support the girl and her family.  now they don’t have to deal with ACC insensitive claims doing everything they can to restrict and decline any counselling support.  And the decimation of social services under this government will ensure that the boy does not receive the appropriate support and rehabilitation which is likely why he became offender in the first place.  He’s probably thinking what is all the fuss about nobody gave a shit when when it was being done to me.

    I heard that he bashed out all her teeth, ALL of her teeth. And that the surgeon/s who operated on her are undergoing a lot of counseling (and will need to for a long time) to deal with the injuries her small, infantile body sustained. I heard this from a friend who’s sister works at the hospital.

    Let’s have a look at the evidence:  
     - The parents left the children sleeping in the caravan on their own at about 10.30pm.  She was doing laundry (If I can rightly remember, and the father was doing something on the computer, not far from their caravan). - The mother came back and the door was locked (why would the culprit lock the door?) - She looks through the window and sees a man lying on her daughter (this was at around 10.30pm-was the light on? (hmmm!).     On the news, when the caravan was shown, the curtains of the window were tightly drawn.     There would have been a noise when she tried to open the door surely?     That noise would have surely been heard by the accused, and yet he was still lying on the girl        when the mother allegedly went to the window and looked in.  - Mother on seeing the man starts screaming- and yet none of the other campers who were  nearby heard her screaming!!?? - Nek minnut, within a week, police have arrested someone; the accused, sixteen years old – oh please, its just too easy. - The little girl (yes it is the vulnerable who suffer) had to undertake four hours of surgery.  How unbelievably traumatic.  Indeed for her parents too.      But now I’ve read that the family are carrying on with their holiday and are known to be somewhere in the South Island at this point in time!Question  I would put this to ‘anyone’ out there; would you want to carry on with your holiday after having been through something as traumatic as what happened to this little girl and her family?  -Now we hear that the accused is likely to plead guilty?!-We only have the parents word for what happened.  They need to be cross-examined in court so that the truth can be known.  What about the girl herself-what does she say? -WAKE UP PEOPLE!!!!!P.S.  There has been an account set up where the public have given over $60,000 –SUCKERS!!!
