Mayor Len Brown has taken legal advice after  Whaleoil understands he is unhappy about the discovery that hotel stays that were not related to the Ms Bevan Chuang sex scandal have also been included in the EY report.  He is seeking legal advice.  

A Whaleoil Investigation shows that people within the council have questioned Brown’s motives.  With a chauffeur driven mayoral car at his disposal 24/7, and a 20 minute trip home, going to a city hotel for the night appears to require a better explanation than “late night, early start”.

Sources close to the story have said that they believe Len Brown wasn’t alone on such occasions.

SkyCity Grand staff were asked about the detail of Len Brown’s stays but they have declined to comment as per their policy on not discussing their guests for privacy reasons.

It is understood Brown’s legal team are attempting to have the additional SkyCity Grand visits classified as private stays, and therefore outside the scope of the EY inquiry.

    If I booked a hotel room for work purposes and didn’t tell the finance team I’d hope the door doesn’t hit my arse on the way out

    If they were free because of his role as mayor they are not private and should have been declared.

      Hotels privacy policies.
      Would they bar a council (or business), in the job of balancing the books, asking for a list of the nights any of their employees booked a room under the name of their employer? If an employer was paying surely the hotel would be duty bound to give receipts.

        Would depend on the policy. If an employer has an arrangement for discounted prices for its staff, as long as it is paid for directly by the employee and not charged back then recovered by the employer, then no they probably wouldn’t need to supply receipts to the employer. If charged back to the employer and then recovered then yes the employer is entitled to copies of invoices. For government type organisations though then you would need to consider any disclosures such as interest registers etc.

    It’s quite simple; the draft EY report must now be turned over to the Auditor-General for a comprehensive independent inquiry. And Len Brown should stand aside as mayor until the A-G reports back.

    Tell me one and all whether this situation would be tolerated in the corporate sphere.
    The Chairman either fraudulently charges up accommodation against the company or uses the company’s influence to secure free services and thereby puts the company into a moral debt to the service provider.

    How would the shareholders respond? How would his directors respond? Would the Chairman have the luxury of vetting the auditors report before it is released to the shareholders. This whole situation is obscene and if not resolved soon requires government intervention and a Commissioner appointed.

      As an auditor we always give management a right of response to any issues we have found to raise, it is the reasonable approach to take. If they stall us or take too long to reply then our report gets issued without their response noting that the opportunity had been given.
      A double check with whoever you are reporting on can result in amended wording or an improved understanding of a situation, as well as avoiding unnecessary conflict while still communicating required issues to the appropriate people. They get the right to respond, though there is no right of veto.

    It is private no matter if he stayed late – early start or he had regular parties.

    It really is quite simple.
    You either paid for the rooms or you didn’t. If you did, you will have a receipt, or a banking record. If you have lost your receipt the hotel will give you a copy.
    If you have receipts but refuse to hand them over, don’t be surprised if people look at you strangely and frown, because quite frankly Len, it is really really hard to understand just why the fuck you would do that.
    Of course if Council paid, then Council will have receipts. If the stays were legit, what is the problem? Of course if no-one paid, then there is a bit of a problem. Thats because Len, when you work under a set of rules that say that gifts have to be declared, that means that you have to declare gifts. Difficult concept to grasp at first I know, but after a while you will get the hang of it. One sure fire way of telling, especially when it comes to hotel rooms, is to watch the bloke checking in and out before you. If they had to get a credit card out of their wallet and hand it over when checking in/out, and you didn’t, then there is a pretty good chance you received a gift, and you should have declared it.
    Better still, do some practice now. Go down to Sky City and ask for a room for the night. If the check in / check out process is a little different to what you remember, then there is a good chance that the last time you stayed there you didn’t have to pay. Because Len, the chances of Sky City giving you a free room tonight aren’t high. Think of a number resembling the shape your thumb and forefinger make most mornings and you won’t be far off.

    And guess who’s paying that bill?

    And why, pray tell, did the ACC CEO find it necessary to engage a lawyer in order to extract the relevant info in order that EY could conduct their investigation?

    Those are big questions in and of themselves that require answers from the man who caused that to happen. And while they are big in and of themselves, they pale into insignificance by comparison to all the other expensive maneuverings that have arisen due to the inappropriate actions of one man. e.g. the EY fee won’t be small, either.

    And guess who’s paying all of those bills?

    Meanwhile the grass on the berms grows ever higher…
