The clock is running – Day One

The EPMU have still not filed the 2005 and 2006 Audited accounts as I highlighted yesterday.

From the Societies Office Website states:

When do you need to file a financial statement?

Each incorporated society should file a financial statement with the
Registrar as soon as possible after they have been approved at the
Annual General Meeting (AGM).

How do you file a financial statement?

There are two ways to file a financial statement – online using your
registry key or by filing paper forms.

Do you need to get your financial statements audited?

The Registrar doesn’t require financial statements to be audited. The
rules of a society will specify whether an auditor must be appointed.

    Seems there’s a mighty big stench there just waiting to be uncovered…

    When other unions can rack up over $150K in overdue taxes and get away with it for years.. the EPMU will be giving the finger to the Registrar or official that monitors these returns saying something a kin to “shove ya rules – we don’t follow them, we make them – ’cause we’re the union”

    …well, it’s about time some EPMU heads were knocked together in the hope it knocks some sense into them..

    I think this post is all about putting the clock on EMPU to file their audited 2005 and 2006 accounts. Nothing more.

      I’m not so sure Timandtim, the Companies office and Societies Office are notoriously slack when it comes to this sort of thing. They seem to have a deep dread of enforcing the rules and using the legistation available to them to sanction the officers responsible for non-filing.
      The worst that EPMU can expect is to have “their file passed over to the enforcement unit”. Nek minute: wet bus ticket.

    They’re probably counting on destroying them (rather than furnishing them) as it comes up to the 7 yrs that documents need to be kept for

       no they must file – as it was a legal requirement. You still have to file your tax returns – just you can destroy everything after 7 years.

      Any way a big place like EMPU wouldn’t want to be questioned on non filing of returns surely?

      I had a look at the 2006 accounts. It will be interesting if they are the same numbers as the excel spreadsheet.

      Their auditors are very reputable and have alot of faith in them.

      Actually it is – see when we brought the matter to MUNZ Unite and NZCTU who also didnt file their accounts – they filed straight away.

      What came out of it was MUNZ had a $600k loss over two years – NZCTU a loss of $114k over two years and Unite is insolvent.

      The Unions tell the corporate world and how to run a successful business.

      Most Unions tell their members you can have a copy of the Union accounts if you request a copy.

      Finally Unions like incorporated societies enjoy certain legal status if registered. One of their duties as good citizens is to file their accounts with the MED (audited as per their own rules) – no different than filing your tax returns.

      EMPU have not filed two years of audited accounts, 2005 and 2006  – and interesting enough the excel spreadsheets for 2006 and 2005 show a combined loss if $2M – I think that needs to be verified.

        Timand tim and Balanced View – don’t you also think it will be very interesting if the filed 2006 audited accounts dont match the what has been loaded in the public domain

        Thanks double t. I don’t understand this, so I guess what I was trying to say is that what are the implications of this? It seems so long ago now to be any real relevance regardless of how they read.
