A 425-pound man has been sentenced to 32 months in jail after pleading guilty to grabbing a 10-year-old boy and sniffing his arm.
Victor Joseph Espinoza, 56, who has a previous conviction as a gang member, struck a deal for past charges of street terrorism and gang activity to be dismissed if he pleaded guilty to the false imprisonment charge.
Espinoza, of Santa Ana, California, approached the boy and his 19-year-old cousin on October 4, 2012, and asked the 10-year-old if he’d like to see his gang tattoo.
When the boy stopped, Espinoza grabbed the youngster’s arm and sniffed it, according to prosecutors.
The boy managed to escape Espinoza’s grip and his cousin yelled at the obese man before he and the boy ran away, CBSlocal.com reported.
It was originally reported that Espinoza had plotted to kidnap the 10-year-old boy, but he was too heavy to make good his escape.
A police helicopter spotted him trying to hide in a residential backyard.
Espinoza again attempted to flee over the yard’s fence, but was unable to haul his ample body across.
