Helen Clark has come back and decided to declare that all the spying she did was legal, despite claims for the past year by David Shearer and the media that there were 88 cases of allegedly “illegal” spying.

The media and David Shearer won’t believe John Key when he says there wasn’t any spying but the law is unclear so it needs clearing up, but in walks Helen Clark and they take what she says as gospel.

Former Prime Minister Helen Clark has confirmed the GCSB executed intercept warrants for the SIS during her Government but spying on New Zealanders “wasn’t their remit”.

Clark, speaking in advance of the release of her new book At The UN, about her first four-year term as Administrator of the United Nations Development Programme, said she was always “loyally and diligently” served by the intelligence services.

Clark said the Government Communications and Security Bureau acted within the law “as it was understood to be” and this included executing warrants for the Security Intelligence Service.  

“I can assure you that I was always advised that what was being signed was legal.”

She rejected that the Government Security Communications Bureau routinely spied on New Zealanders as that was “not part of their remit”.

Well good, glad that is all cleared up then.

Perhaps David Shearer might like to withdraw this graphic then now that Helen Clark has declared everything to be above board.

    The 2003 law is full of ambiguity and loopholes. The Government would not be doing its job if it didn’t clean up the mess so that everyone understands what the GCSB can and cannot do.

      Clark’s comments on this are very relevant and not to be scorned in the manner of some commenters above. The law was a cock-up. She knew what she wanted it to say and thought that it said it. Exactly the same with Key. KS is quite correct when he says that it completely undermines Shearer’s position. Maybe she did that deliberately. We know she has no truck for the Greens and wouldn’t hesitate throwing them under the bus. Maybe she thinks it’s time for Shearer to go.

      The point you miss is that they wont clean up the mess the new law will also be full of ambiguity and loopholes and the cycle will continue.

      This has been written by the spys themselves for themselves, so they can interpret it anyway they want and the cycle continues. Nobody is to understand what they can and cannot do.

        I think you’re reading the old bill, not the new one. The whole point of the bill is to tidy up the loopholes and remove the ambiguities. Everyone knows the current legislation is not fit for purpose, so why would you not want it tidied up?

    • And there’s the rub Mr Blobby. Clark didn’t think that what she was signing off was illegal because the 2003 Act was such a dog. But Rebecca Kitteridge found a potential 80-plus cases that were potentially unlawful, dating back to Clark’s time as PM.

      Helen Clark is a very intelligent woman. But even she was tricked by the ambiguity of the law that she herself steered through the House. That’s why change is essential.

    The graphic above implies there were 88 cases of illegal spying
    Of those 88 cases, it’s been determined that the majority occurred under the Clark labour regime
    Clarke says about those cases that occurred under ***HER*** watch that the GCSB was operating within the law “as it was understood to be”

    So where do you stand, labour? Were the 88 cases illegal, or weren’t they? If you deem them to be illegal, are YOU going to take responsibility for them, as they occurred under YOUR watch? And if the law at the time was a dog which allows Clark to come out with such a classic shirk of responsibility, shouldn’t you support legislation that ensures the remit of operation is more clearly defined?

    Seems to me that the bigger scandal here is not the tightening up of the legislation, but the fact that the leader of the labour party allowed such shoddy legislation to be passed by her government, and then took advantage of it. We have a case of actual rights violations here under a labour government, and yet the press is silent?
